Terms and Conditions

Service Provider: EpochalStorm Games SRL with registered office in Rome, Italy.
Access to and use of the application (“Service”) implies full acceptance of these Terms and Conditions of Use (“Terms”).

We invite you to read them carefully before you start using the Service.

1. Nature of the Service
The Service is a social entertainment game “Burraco Friends”. It does not in any way constitute gambling, betting, or prize competitions. Any “game currency” or “virtual credit” used in the Service has no real economic value and cannot be converted into money or goods.


2. Age Requirements
Use of the Service is reserved for adult users (18 years of age or older). By registering, you declare that you are at least 18 years old and possess the legal capacity to accept these Terms. The Provider reserves the right to request age verification at any time (for example, via an identity document or other suitable proof) if there is reasonable doubt regarding the truthfulness of the declared age.
In case of refusal to provide the requested information or a well-founded suspicion of false data, the Provider may suspend or close the account until clarification is provided, or permanently in the event of a confirmed violation.


3. User Account
To access certain features, you may be required to create an account. If you do so, you are responsible for the truthfulness of the data provided and the confidentiality of your credentials. In the event of unauthorized use of your account, you must inform us promptly. The Provider reserves the right to suspend or close the account in case of violation of these Terms, abuse, fraud, or behaviors contrary to the law or platform regulations.


4. User Content
You may share texts, images, messages, and other content (“User Content”) in compliance with the law and other users.
The User retains ownership of their content but grants the Provider a license to publish and display the content within the Service; this license is non-exclusive, revocable, free of charge, and limited to use.
It is not permitted to publish offensive, defamatory, obscene, discriminatory content or content that violates the rights of others.


5. Responsibility for User Content
The Provider shall in no way be held responsible for behaviors exhibited by Users in violation of these Conditions or current legal regulations. In such cases, the Provider will adopt every appropriate measure to prevent, limit, or suppress such conduct, also based on reports received and community collaboration. The correct functioning and positive environment of the game depend, in fact, on the respectful, fair, and collaborative behavior of each User.


6. Currency and Virtual Items
The Service may include credits, items, or virtual currency. These:
• do not represent real money;
• are not refundable or convertible into money;
may be lost in case of suspension, account closure, or termination of the Service. Any purchases of virtual currency constitute limited, non-transferable licenses for use, subject to these Terms.


7. Gaming Conditions
1. User Obligations
The User agrees to use the Service in full compliance with the game rules, these Conditions, and any instructions published by the Provider. The User also agrees to maintain fair, loyal, and respectful behavior towards other Users and the Provider, refraining from any action that could compromise the proper functioning, integrity, or experience of the game.
2. Prohibited Conduct
Any behavior, act, or omission that, even potentially, could alter the regular course of the game or cause harm to other Users or the Provider is prohibited. By way of example but not limitation, prohibited conduct includes:
1. the use of tools, software, scripts, or other techniques capable of altering game mechanics, statistics, scores, or results;
2. the illicit or unauthorized accumulation of points, currency, or virtual items;
3. any behavior aimed at "cheating," i.e., altering, through unfair means, one's own or others' performance and statistics (including teammates or opponents);
4. organizing with other players to alter the normal course of matches, through abandonment or any other technique suitable for cheating;
5. intentionally abandoning matches, thereby altering results and causing concrete damage to the balance and fairness of the game;
6. any behavior aimed at exploiting, directly or indirectly, any bugs, glitches, programming errors, or other malfunctions of the game to obtain advantages, points, virtual currency, items, or results not conforming to normal gameplay (the User is required to promptly report any bug or malfunction they become aware of to the Provider and not to disclose its nature or methods of use to third parties);
7. creating fictitious accounts to gain advantages in the game;
8. the use of offensive, obscene, vulgar, or blasphemous language, as well as discriminatory, xenophobic, defamatory, violent, or pornographic expressions or content;
9. insults, threats, or offenses directed at the Provider, its collaborators, the game, or associated brands, in any form or means of communication;
10. communication (by any means) with one's teammate or even opponents for the purpose of gaining an illicit advantage and altering the correct functioning of the match;
11. improper use of spaces provided for communication (including but not limited to: Username, Motto, Public Chat, Private Chat, Club Chat) for the dissemination of commercial messages, spam, and potentially harmful links such as web addresses, social accounts, and more.
3. Provider's Right of Intervention
The Provider reserves the right to adopt, at its discretion, any measure deemed appropriate in case of violation of these Conditions, including but not limited to: temporary or permanent suspension of the account, removal of content, resetting of game progress, or permanent exclusion from the Service, without this entitling the User to any right to refund or compensation.
4. General Clause of Fairness
Even if a specific conduct is not expressly mentioned in these Terms, the Provider may still intervene if it results, in its sole judgment, contrary to the principles of fairness, loyalty, and respect that must guide the use of the game and the participation of the community.



8. Payments and Refunds
Any transactions are managed through the official app store channels (“Google Play” and “Apple App Store”). The Provider does not directly manage or approve refunds related to purchases made through the Apple App Store or Google Play Store, which remain the full responsibility of the respective operators.
Except as provided by law, payments made are final and non-refundable. This does not affect consumer rights regarding withdrawal or legal warranty, where applicable.


9. Moderation and Reporting
The Provider may monitor and moderate communications and content within the game exclusively for safety purposes, child protection, prevention of abuse, and compliance with the Terms. Access to private messages occurs only in the event of reports or obvious violations, in compliance with privacy regulations.


10. Intellectual Property
All trademarks, logos, texts, graphics, source codes, and materials of the Service are the property of the Provider or its licensors. The user may not copy, modify, or distribute them without written authorization.


11. Privacy and Personal Data
The processing of personal data is governed by the Privacy Policy available separately and compliant with EU Regulation 2016/679 (GDPR). The user has the right to access, rectify, delete, and object to the processing of their data as provided by the GDPR.


12. Limitation of Liability
The Service is provided “as is”. While committing to ensure availability and security, the Provider is not responsible for:
• technical interruptions or malfunctions;
• loss of data or game progress;
• indirect or consequential damages not attributable to willful misconduct or gross negligence of the Provider.
Nothing in these Terms excludes or limits the Provider's liability for willful misconduct, gross negligence, or violation of obligations deriving from mandatory provisions of law.


13. Changes to the Terms
The Provider may update these Terms at any time for technical, legal, or organizational reasons. Changes will take effect from the moment of publication or from a later specified date. Continued use of the Service after the change implies acceptance of the new Terms.


14. Suspension or Termination of the Service
The Provider may suspend or terminate the Service, in whole or in part, for maintenance, technical problems (caused by us or third parties), security reasons, or cessation of business. In case of permanent closure, personal data will be deleted or anonymized according to the Privacy Policy.


15. Legal Protection
In case of serious or repeated violations of these Conditions, or should the User's behavior cause or potentially cause damage to the Provider, the game, the platform, or other Users, the Provider reserves the right to take action in the competent civil and criminal courts to protect its rights and interests. This option is in addition to, and does not replace, the other measures provided in these Conditions (such as account suspension or closure).


16. Governing Law and Jurisdiction
These Terms are governed by Italian law. For any dispute, the exclusive jurisdiction shall be the court of the Provider's registered office, unless otherwise provided by mandatory law.

By accepting this document, you expressly declare that you have viewed, understood, and accepted all the points listed.
